The not counted ~ 10% overhead are Ethernet Overhead that should be only between the PC and the Modem but not cross the ISP line.
Windows shows in the task manager the raw bytes write to the NIC including Ethernet headers, instead of IP traffic only.
Howe ever it seams that some ISP's are specifying their maximal line throughput including said overhead, what is technically cheating.
So since the average user does not grasp the complexity of all OSI layers and was lied to by his ISP I added the Ethernet frame overhead to the overhead calculation for now.
So even its technically wrong it looks much more right
